Apple and Amazon, fined 194 million for limiting competition on the Amazon Spain website

Both Apple and Amazon have announced that they will appeal the fine, the second highest imposed by the National Markets and Competition Commission (CNMC) in its history.

The National Markets and Competition Commission (CNMC) has fined different companies in the Amazon and Apple groups a total of 194.15 million euros for agreeing and implementing certain restrictions on competition in the online market or ‘market place’ of Amazon in Spain that affect third-party resellers of Apple products and competing products of the apple firm.

Specifically, the fine for Apple companies rises to 143.64 million of euros and the one imposed on Amazon is 50.51 million of euros.

As reported by the agency, both companies agreed to include a series of clauses in the contracts that regulate Amazon’s conditions as an Apple distributor that affected the sale of Apple products and other brands on the Amazon website in Spain.

On the one hand, They “unjustifiably” restricted the number of resellers of Apple products on the Amazon website in Spain and, on the other, They limited advertising spaces where competing Apple products can be advertised on the Amazon website in Spain, the CNMC has detailed.

Finally, they limited the possibility of Amazon directing marketing campaigns to customers of Apple products on its website in Spain to offer them competing products from other brands.

This is the second highest fine that the CNMC has imposed in its history, only surpassed by that of 203.6 million euros applied to six of the main construction companies in Spain for altering the competitive process in infrastructure construction tenders for more than 25 years.

A contentious-administrative appeal can be filed directly against this resolution before the National Court within a period of two months from the day following its notification, as indicated by the CNMC. Sources from both companies have been quick to indicate their intention to appeal the fine imposed by the agency as they completely disagree with it.
